Terms of Use of “Landea.gr”
1. Introduction
The present terms of use define the conditions of use of www.landea.gr (hereinafter “the website”) operated by the company “NEWSPHONE HELLAS S.A.” (hereinafter “the Company”). In particular, through this website, users may search for properties which are listed for electronic auction (hereinafter “the Service”) and services related to these properties. The search criteria and the provision of the service may change at the company's sole discretion, without entitling the user to any compensation due to such changes
2. Available Services / Service Categories
2.1 Visitor
By means of the Service, the visitor may search the website for properties in Greece which have been listed for electronic auction, by using search criteria available on the website. From the properties’ shortlist that matches the visitor’s criteria, the visitor may seek additional information regarding such property, such as geographical location on the map, description of the property, photos or may be redirected, through a link, to the Electronic Auctions’ website (www.eauction.gr)
2.2. Subscription Service
2.2.1 Registration and Profile Creation
Users may register for the Subscription Service, which grants them access to additional content and features of landea.gr, by creating a user account. Interested users must provide their full name, a valid email address and a user password. Alternatively, they can register using their Facebook or Google accounts.
2.2.2 User Registration Requirements
The registration on landea.gr is only permitted to individuals over 18 years of age and legal entities. In particular as regards the registration to the subscription programmes “Landea Premium” and “Landea Pro”, users (individuals or legal entities) must legally possess a debit, credit, or prepaid card and a valid telephone number, which must be provided upon registration. The subscription service is personal. Subscribers must immediately inform the Company in case they detect unauthorized use of their account.
The Service is subject to fair usage limits. If a subscriber exceeds these limits, their account may be deactivated and automatic renewal will be suspended. The subscriber will be encouraged to contact landea.gr in order to investigate what has happened. Reactivation of the account is at landea.gr’s sole discretion.
In case of deactivation of the account, the following applies regarding subscription service charges: if a monthly subscription has been agreed upon, the already paid monthly fee is non-refundable. If an annual subscription has been agreed upon, half of the fee corresponding to the remaining term until the end of the subscription period will be refunded.
The Company reserves the right to suspend a user's access to the Service at its sole discretion, without notice, in case the user violates these terms and for as long as such violation continues (indicatively in cases of automated data extraction, multiple-user access under one account).
2.2.3 Subscription programmes
The available subscription programmes are three: Landea Free (free subscription), Landea Premium (paid subscription), and Landea Pro (paid subscription). Users can find details about the subscription programmes at www.landea.gr/pricing
It is clearly stated that after discontinuing a Landea Premium or Landea Pro subscription, the user’s account is retained (including saved searches and saved properties, up until the Landea Free programme limits and the user may use the Landea Free programme (free subscription).
2.2.3.1. "Landea Free"- Free Subscription
"Landea Free" subscribers may save property of interest and receive email notifications regarding updates to the property they have saved or receive notifications regarding new listings matching those already saved in their account. The Landea Free subscriber is allowed to perform up to fifty (50) searches per day.
2.2.3.2. Subscription programmes “Landea Premium” – Paid
α) In case the “Landea Premium” subscription service is selected, the subscriber acknowledges that the subscription will continue indefinitely until canceled. The subscriber may, at any time, log into their landea.gr account and terminate/cancel the subscription service. In such a case, the subscriber will continue to have access to the “Landea Premium” service until the end of the billing period (depending on whether this is monthly or annual). The cancellation of the subscription will take effect at the end of the current billing cycle (month or year, depending on the subscription duration). Under no circumstances will amounts already paid be refunded, nor will any refund be granted for unused subscription days due to cancellation.
The purchase of the “Landea Premium” subscription programme is carried out exclusively online through the landea.gr website using a card. The user selects the type of subscription (monthly or annual) and simultaneously grants the company the right to charge their card automatically for each equivalent period (per month or year, depending on the subscription type selected by the user) without requiring any further authorization or additional formalities. The user, thereby, enters his/hers mobile phone number and confirms it via a code he/she receives. Finally, users proceed with the subscription purchase by entering their card details.
The Company does not store card details. For the payment process, users are redirected to the secure payment environment of Viva (https://www.viva.com/).
β) Payment Method
Monthly:The “Landea Premium” user’s card is charged upon registration and subsequently automatically every month on the same date (e.g., 11/05, 11/06, etc.).
Annual:The user’s card is charged upon registration and then automatically once per year, with the total subscription amount for the twelve (12) months.
The subscriber may monitor their card charges through their profile on Landea.gr. Additionally, they will have the option to delete or add a new card, always through the secure payment environment of Viva. If there is a payment failure, access to “Landea Premium” content is suspended at the end of the already paid subscription period, and the user is notified via email.
c) ) In the event of a price increase for the subscription programme, subscribers will be notified via email at least 60 days prior to any changes taking effect. If subscribers do not agree with the new price, they must cancel their subscription in a timely manner-before the change takes effect—otherwise, they will be charged the new price.
2.2.3.3. "Landea Pro" (Paid Subscription)
This subscription is not available for direct online purchase. Users interested in purchasing the "Landea Pro" subscription must express their interest via www.landea.gr/pricing, where details about the subscription packages are available.
3. Third-Party Services
Through the Service, the user may be facilitated in communicating with third parties who provide information and services related to the auctioned properties. The role of the website, as a mere intermediary of information society services, is limited to storing of information by a service recipient and facilitating communication with each property’s assets’ servicer, as applicable, by forwarding to them any request for information or services submitted by the respective user. The use of the service constitutes the user’s unconditional acceptance of these terms.
More specifically, the user may seek additional information, beyond what is already available, for such properties that this option exists (hereinafter "connected properties") by completing the relevant request- contact form. Requests for the provision of additional information beyond what is displayed on the website regarding the connected properties shall be forwarded to the respective assets’ servicers or right holders of such properties, so that these latter shall provide the requested information directly to the user, without any intervention or responsibility on the part of landea as regards the accuracy of the third-party’s content.
4. User’s Obligations
Use of the Service constitutes the unconditional acceptance of these present terms in accordance with the principle of good faith and fair commercial practices. The use of any material or information obtained from the Service is taking place under the sole responsibility of the user. Users are expressly forbidden to use unfair or fraudulent methods to extract information or data, including automated data collection techniques or software, for either personal or professional purposes. Each user is solely responsible for protecting his/her personal equipment and software from viruses.
Furthermore, users shall, at the time of registration, provide their true personal data and shall in no case impersonate another person or register incorrect or false personal data. Each user account is strictly personal. Access credentials to the Service are personal and the user shall keep them confidential at all times. In case of any modification of his personal information the user shall inform the Company by registering the new correct data, so that the personal information he/she inserts are always updated, true and correct.
5. Intellectual Property
This website is the property of the Company. The Service and the content (including but not limited to: data, databases, software, photos, videos, information, logos, trademarks) which appear or are available to visitors on this website are solely intended for personal use and are protected by intellectual property laws (Law 2121/1993) as well as both European and national laws regarding trademarks of the Company or third parties. The display of information on our website does not constitute a transfer or assignment of a license to use such information. Any copy, reproduction, presentation, adjustment, modification, publication, distribution of the Service or/and the content of the website, in any way whatsoever, in whole or in part, whether it belongs to the Company or any third party is strictly prohibited . Modification and/ or deletion of any intellectual property rights, trademarks or photographs that may appear on the website or the relevant maps is similarly forbidden.
6. Limitation of liability of the Company
The content and the Service are provided «as is». The Company is not responsible for the availability, soundness, accuracy, or completeness of the information provided. The Company is not responsible for any decisions taken by the users that are based on information contained in its database or are available through the present, solely informational, website. The content of the website neither serves for advisory purposes nor does it provide any guarantee whatsoever regarding the soundness, accuracy, or completeness of the relevant information.
The Company does not guarantee that the Service will be available at all times without interruptions nor that it shall operate without errors or disruptions. Interruptions may occur due to technical reasons beyond the Company’s control, especially in cases of non-availability of the internet, or maintenance services, updates or temporary interruption of the Service. The user acknowledges that such measures and temporary non- availability of the Service do not constitute a defect. The Company is not liable for any damage suffered by the user as a result of the use and/or non-availability of the Service and/or of the information of this website. The Company is not liable for any damage suffered by any User, as a result of the unauthorized use of his/her personal credentials by a third person. Ιn any case, any illegitimate or unauthorized access or other malicious ac that appears to have been made with the use of the personal credentials of a user, shall be presumed to have been made by the user himself.
7. Links to other webpages
This website may contain hyperlinks to other websites, which are controlled by third parties. Hyperlinks are only provided to facilitate users and it is not to be implied that the Company endorses or controls these websites, or commercially promotes their content. In case that the user chooses to follow these hyperlinks, he/she is, hereby, fully informed that he/she leaves thereby the Company’s website. The Company has no responsibility over the content of the website to which the hyperlinks redirect the user to, nor for the protection of the confidential information that the user provides when visiting such websites, nor for any financial or any other loss or damage that the user may suffer. The user should act with caution and always be informed of the Privacy Policy and the Terms of Use of the websites he/she visits. It is possible that our website contains third party advertisements the content of which is not controlled by the Company. Our Company is by no means responsible for any damage that may arise from any transaction between a User and a third party advertised on the website.

The Company, in compliance with the General Data Protection Regulation (REG 2016/679) on the protection of natural persons, with regard to the processing of personal data and Law 4624/2019, implements all necessary measures for the protection of your personal data. The Company retains in force and applies a Privacy Policy for the protection of Personal data, which can be found on the Company’s website. Upon registration of a user, the Company collects and processes the data that you insert for the purposes of the provision of the Service, as described herein, and for the dispatch of promotional messages relating to the Service ( the so-called “soft opt-in” as provided by article 11 of Law 3471/2006 and the e-Privacy Directive).

9. Transaction Security
To ensure the security of your personal data, the company applies automatic encryption. The company utilizes secure encryption methods and the most widely accepted security protocols to safeguard its internet applications (SSL, HTTPS, etc.). Approved security certificates are used for user authentication. Security certificates rely on SSLv.3 encryption technology (at a minimum) (Secure Socket Layer). Privacy is ensured by encrypting all messages at the SSL Record Protocol level. Additionally, SSL provides mandatory authentication of the server's identity and optionally of the client’s identity through valid certificates issued by trusted Certificate Authorities (CAs). SSL is a globally recognized internet security standard, offering encrypted SSL communication based on symmetric & asymmetric cryptographic keys.

12. Final Provisions
These present terms of use are interpreted in accordance with Greek law. In case of any dispute arising in relation to these terms, the competent courts shall be those of Athens, Greece.
Invalidity of one or more terms has no effect on the validity of the remaining terms.
